In These 5 States settled All Pending Cases from Decades

India's judicial system often faces this problem, but 4 states and a Union Territory have shown a different path. In these subordinate courts, these states have almost settled the cases pending for a decade or more. Haryana, Punjab, Himachal Pradesh, Kerala and Chandigarh have achieved this success by improving the Justice Delivery System.

The number of cases pending for a decade or more in the country is close to 23 lakhs. 9% of the total cases are hanging in subordinate courts across the country. Apart from these 5 states, five other states - Delhi, Assam, Madhya Pradesh, Andhra Pradesh and Karnataka are also not far behind. These states have also brought the cases pending for decades to nearly one per cent. However, it does not include figures of cases stuck in the Supreme Court or the High Court.

There are about 2.54 crore cases pending in nearly 17,000 subordinate courts of the country. According to the latest figures released by National Judicial Data Grid (NJDG), 22.76 lakh cases are pending for 10 years or more. There are a number of pending cases in some states like Haryana, Punjab, Madhya Pradesh, Karnataka, Kerala and Delhi. In such cases, cases pending for decades have been shown to indicate the success of the judges in these states and the success of the steps taken by the government and the High Court.

The result of the hanging of the case is seen in the presence of a large number of under-trial prisoners in prisons. According to government estimates, two-thirds of the total prisoners of the country's prisoners are undertray. In such a situation, some states are seen coming out of this challenge by taking corrective steps while some are still struggling. Courts of Gujarat, Bihar, Uttar Pradesh, Odisha and West Bengal are still littered with cases pending for decades.

Gujarat is at the top in this case. Of the total pending cases in the subordinate jurisdictions of Gujarat, the share of cases pending for decades is close to 20 per cent. It is 17 percent in Odisha, 16 in Bihar, 13 in UP, 12 in West Bengal and Uttarakhand and 11 percent in Jammu and Kashmir. In such a situation, there is a need for radical change to make the country's delivery system effective and responsive. People need automation to avoid delays in fulfilling the formalities related to the cases.

The government is already taking such steps. Some technical platforms such as National Judicial Data Grid and Court Software have been developed. All the cases here are being uploaded with real time updates. Case status is also available online. There has also been provision for updating litigation and attorney through mobile phone and text message.

Most senior citizens and women are worried with pending cases. In the case of peddling cases, the share of these cases is about 15 percent. In today's case, 11 lakh cases of senior citizens and more than 26 lakh cases of women are hanging.
